Scope

This policy describes how Saratoga Capital Advisors, LLC (“Saratoga,” “we,” or “the firm”) handles information about visitors to saratogacapadvisors.com, including the investor access area, and about prospective clients who contact the firm through this website or by email.

Clients who open an account receive a separate privacy notice under the Commodity Futures Trading Commission’s privacy rules (17 CFR Part 160). Where that notice and this policy differ, the client notice governs the client relationship.

Information we collect

Information you give us. The Request Materials form asks for your name, email address, telephone number (optional), firm or organization (optional), investor type, a preliminary self-assessment of Qualified Eligible Person status, and any message you choose to include. If you correspond with the firm by email, we keep that correspondence. If you are issued an investor access code, we record the code entry, the acknowledgment you give on entry, and the pages and documents you open in the investor access area.

Information collected automatically. Our hosting provider keeps standard server logs: the requesting IP address, browser type, pages requested, referring page, and time of request. When you submit the Request Materials form we record the time of submission, a one-way hash of your IP address, your browser type, and the page from which you submitted, together with the consent wording shown to you at the time.

What we do not collect. This website does not use advertising or analytics cookies, tracking pixels, or third-party audience-measurement services. It does not collect payment information. No information is knowingly collected from anyone under 18; this website is not directed to minors.

How we use it

We use the information described above to:

  • respond to your inquiry and correspond with you about it;
  • verify eligibility under CFTC Regulation 4.7 before furnishing program materials, and document that verification;
  • furnish program materials, account documents, and the investor access area to persons whose eligibility has been established;
  • keep the books and records that CFTC regulations and National Futures Association rules require, including records of promotional material and of the persons to whom it was furnished;
  • operate, secure, and troubleshoot the website.

We do not sell information about visitors or prospective clients, and we do not use it for automated marketing calls, text messages, or advertising on other websites.

Who we share it with

We share information only as needed to operate the website and respond to you, and only with:

  • Service providers that process it on our behalf under contract: our website host (Vercel), our database provider (Supabase), and our transactional email provider (Loops). These providers may store information in the United States.
  • The futures commission merchant that carries your account, if and when you decide to open one, and other parties named in your account documents.
  • Regulators and legal process: the CFTC, the NFA, and other authorities where a law, regulation, subpoena, or examination requires it, and our professional advisers under confidentiality obligations.

We do not share information with third parties for their own marketing.

Cookies and Do Not Track

The public pages of this website set no cookies. The investor access area sets one session cookie that keeps you signed in after you enter your access code; it is deleted when you sign out or when the session expires. A display preference may be stored in your browser’s local storage; it never leaves your device.

Because this website does not track visitors across other websites or over time for advertising, it does not respond differently to browser “Do Not Track” signals. No third party collects personal information about your activity on this website for its own purposes.

Retention and security

Inquiries and the records of materials furnished to prospective clients are retained for at least five years from the date the related material was last used, as CFTC and NFA recordkeeping rules require. Server logs are kept for a shorter period set by our hosting provider.

Information is transmitted over encrypted connections and stored with access limited to personnel who need it to respond to you or to maintain the firm’s records. No method of transmission or storage is completely secure; if we learn of a security incident affecting your information we will notify you as applicable law requires.

Your choices

You may ask what information we hold about you, ask us to correct it, or ask us to delete it, subject to the records we are required to keep. You may also ask us to stop contacting you at any time. Send requests to investors@saratogacapadvisors.com or to the postal address below. We will respond within 30 days and may need to verify your identity before acting on a request.

Residents of California, New York, and other states may have additional rights under their state’s law. The firm does not sell personal information and does not share it for cross-context behavioral advertising. We will honor the rights that apply to you under the law of your state; send requests to the contact below.

Changes

We may revise this policy as the website or the law changes. The date at the top of this page shows when it was last updated; material changes will be posted here before they take effect. Your continued use of the website after a change means you accept the revised policy.
